Santa Ana California – To allow more massage with new regulations

SANTA ANA For the first time in nearly two years, the city has agreed to allow more massage parlors to open.

But here’s the rub: new rules, new regulations and a city-run test for prospective masseuses.

The city blacklisted massage parlors in mid-2007 over concerns that they might operate as fronts for prostitution. At the time, the city was seeing a spike in massage-parlor applications and decided public health, safety and welfare demanded a freeze on such permits.

The City Council voted this week to relax the ban on new massage parlors. But council members also adopted new restrictions designed to give the city a greater say over the location and operation of massage parlors.

New parlors can only open in commercial areas, cannot be within 1,000 feet of other massage parlors or adult businesses and cannot stay open later than 10 p.m. Massage technicians will need either a city or a state license; and to get a city license, they’ll have to pass a city-sponsored test.

The new rules represent the first changes to the section of city code that deals with massage parlors since 1976. Other cities – including Anaheim and Orange – have also taken steps to update their massage regulations in recent years, according to a staff report given to Santa Ana council members.

Inner Sanctum, explained Illingworth, has merged into SYL but will remain geared toward corporate massage.

“I am so excited about owning SYL because it has been a dream realization for me; I always wanted to own a day spa when I got started in therapeutic massage,” said Illingworth.

All of the wonderful head-to-toe SYL treatments will remain on its menu of services, providing a soothing experience where one can retreat and relax.

An added bonus is that the original founder of SYL, Karen Choules, has been delighted to stay onboard to serve her clients.

Illingworth is pleased to introduce more therapeutic treatments to the SYL menu.

“I want to bring in more different types of massage therapy and I hope to create a massage program to make it more affordable in this economy,” she said. “I want massage to be accessible to everyone; that is my vision.”

The Barber Lounge – Theraputic Massage Ban Off In SF

SoMa massage is back!

A South of Market spa owner recently learned how it important it can be to have friends in City Hall.

Back in November, the city shut down Greg Griffin’s therapeutic massage treatments at The Barber Lounge on Folsom Street. It turned out that in the 1980s the city had banned massages in what it defines as SoMa due in part to concerns about sex in massage parlors and bath houses.

Fancy malls and large luxury hotels nearby have opened spas and they are allowed to offer massages because they aren’t technically located in SoMa. Griffin, who runs a chic salon with grooming services — including haircuts, facials and hot-towel shaves — felt like he was at an unfair disadvantage.

After eight e-mails and 10 phone calls to his area Supervisor Chris Daly with no luck, Griffin was at his wits end. Good thing one of his customers was City Treasurer Jose Cisneros. Cisneros went to his friend Supervisor Bevan Dufty, who then crafted some legislation that, in effect, lifts the ban.

“It was really lucky that I had connections at City Hall,” Griffin said. “As a regular Joe, forget about it. This city is really hard on small businesses.”

Rancho Santa Fe’s Morgan Run Club and Resort is seeing the benefits of their $6.5 million expansion project.

The new 15,000-square-foot Spa and Sports Retreat facility fits right into the resort that has been tucked into the Whispering Palms community since 1965. The retreat offers new gym facilities, a day spa and sparkling new pool.

“It gives us more of that whole resort feeling,” said Suzanne Taylor-Sandoval, director of sales.

The retreat is open to golf club members, guests of the 66-room hotel on site and those who have a spa and sports only membership. Since their November grand opening, 80 new members have signed on.

“I am extremely proud to be a member of Morgan Run,” said Terry O’Hara, the chair of the Morgan Run board of governors. “With 27 holes of golf, 11 tennis courts, a beautiful new spa and great members, I couldn’t ask for anything more.”

The center gets its biggest boost in the area of fitness. Before this facility came in Morgan Run was very limited in their fitness offerings, Taylor-Sandoval said.

The new fitness facility not only has beautiful views of the golf course from nearly every treadmill and elliptical, but the facility also boasts state-of-the-art equipment from Technogym. All cardio equipment has television and MP3 player connections and personal trainers are on hand to offer training specific to help improve members’ tennis and golf games.

There is also a large group exercise room for yoga, Pilates and aerobics classes and a separate kids’ club where children ages 2 to11 can hang out while mom and dad exercise.

Pool and spa time
The day spa is also a big upgrade for Morgan Run. The resort had a very intimate spa before, with just four treatment rooms. The new center has seven private and relaxing treatment rooms as well as an outdoor Zen Garden for specialty treatments.

The men’s and women’s locker rooms are also benefitting from the expanded room. Each comes with lockers (name plates for members included), a steam room for unwinding and a card room for socializing.

One of the most anticipated features of the Spa and Sports Retreat is the pool. Morgan Run went three years without having a pool during the construction phases of the new center. The new pool, which offers two lanes designated for lap swimming, comes with a children’s play feature and is surrounded by chaise lounges for sunning and an outdoor cafe. There is also a Jacuzzi.

Taylor-Sandoval said many members were taking advantage of some winter sun over the holidays.

How are your promoting lash extension services?

“Lash extensions are 85% of my spa business. I have been doing lashes for more than three years now, and my best promotion for new business is referrals. I have tried advertising and was never able to get my money back. I average 5-6 lash services a day, so I have built a good lash clientele. When I first started, I needed to build my clientele so I offered free services to everyone I worked with and other stylists I knew. They would be my advertising so when their clients noticed and asked about their lashes, they would give them my business card. In return, I would keep filling their lashes. I also did a monthly mailer discounting the first lash application to all existing clients, as a reminder of my new service. Now that I have more than 100 regular lash clients, this is the busiest time of the year! The holidays are a great time to get new lash clients. By offering party lash flares (just on the outer part of eyes), partial sets (a half-set with a gradual fade into the natural lashes) or fun holiday lashes (false lashes mixed with glitter/colored extensions), you can spend less time on each application and introduce new clients to the service. There are a lot of people that will try the extensions this time of year and only do the lashes for special occasions, but they will be at parties with a lot of potential clients. Lash extensions, when done properly, can be an amazing increase to your business and income! You have repeat business like no other service. Clients love the way they look with the extensions and will come back regularly for fills. For all my regular clients, I give them a free fill for their birthday and they love it. I also have a referral program—for every new customer my client sends me, they receive a free fill. I have a few clients, especially in the current economy, that are working hard at sending me referrals because they do not want to give up their lashes. My business cards are flying out the door! My clients love their extensions and tell me they never want to be without them. There is no better way to advertise than having your work walk around in front of people all day long. And people will always notice other people’s eyes. Remember, extensions are addicting—for you and your clients!”

What were the most helpful sources, including Web sites? Working with the company that produces the technology has been the most helpful in starting our business. No one in Southern California is doing anything similar to Mind Spa.

When were you the most discouraged? When people love the technology, but don’t want to follow through and purchase something.

What company or individual do you admire? Richard Branson, a no-limits entrepreneur who has gone with his gut to make difficult decisions to change the way we all think about travel and music. He has taken big chances and made quick decisions. Sometimes they turn out to be wrong ones, but he always “fails forward,” which has made his growth in business exponential. And Jon Bon Jovi because of his positive attitude.

What will make your business stand out from competitors? It’s uniqueness and ability to help just about anyone with stress relief, lose weight, stop smoking and cope with cancer.

Sandra Caron European Spa File Bankruptcy Spa Closed after Legal Issue

San Mateo spa to pay $500,000 to molestation victim

A San Mateo spa that shut its doors unexpectedly last month has agreed to pay a woman $500,000 after an employee touched her inappropriately during a massage, the plaintiff’s attorney said Wednesday.

Masseur Kevin Bradshaw is serving a one-year sentence in San Mateo County jail for rubbing the woman’s breasts and pubic region without consent at the Sandra Caron European Spa and for inappropriately touching another woman during a massage at a second San Mateo establishment.

“We’re satisfied with the settlement,” attorney Todd Emanuel said. “This corporation is starting to be held accountable for mistreating and endangering its customers.

“Unfortunately, I feel that this is probably just the tip of the iceberg,” Emanuel added, noting that he is representing other women in similar suits against the Sandra Caron spa.

The spa closed at the beginning of October after failing to pay rent on its 3rd Avenue space, and employees and customers say it still owes them unpaid wages and refunds for existing gift cards. The Web site appeared to be accepting credit card statements for gift certificates weeks after the spa’s closure.

Peter Dixon, an attorney representing owners Sandra and Lionel Caron in the civil lawsuit, didn’t return a phone call seeking comment Wednesday. The Carons have filed for Chapter 7 bankruptcy, according to Emanuel.

A judge scheduled a December default hearing for Bradshaw in the civil case after he failed
to retain counsel or respond to the suit.

In a document filed Oct. 28 in San Mateo County Superior Court, the unnamed plaintiff alleges that the Sandra Caron spa re-hired Bradshaw knowing he had been fired from Massage Envy in San Mateo for allegedly sexually battering another customer.

The spa received numerous complaints on the popular Web site Yelp, mostly centering on the decor and alleged nasty customer service, which one user described as “curt and snarly.”

Before closing the spa, the Carons filed a lawsuit alleging former employees wrote some of the negative Internet reviews.

San Mateo business shut down without warning, city and state officials are told
Former employees and clients of a San Mateo spa that closed last month have told city and state officials that the business shut down without warning — and failed to make good on outstanding wages and gift certificates.

The state Department of Industrial Relations said a former employee of the Sandra Caron European Spa on Third Avenue filed a complaint for $6,000 in unpaid wages for hours worked between July 14 and Oct. 10. If officials find in favor of the plaintiff, the spa may also have to pay nearly $2,800 in penalties, said Erika Monterroza, a spokeswoman for the agency.

A second employee, who worked as an aesthetician and asked that her name not appear in print because she feared reprisal, said the spa owed her more than $300 in wages for the first five days of October. The woman said four massage therapists and another aesthetician also never received their paychecks.

Between seven and 10 former clients of the spa called the San Mateo Chamber of Commerce and the Downtown San Mateo Association about unredeemed gift certificates, association Executive Director Kelly Mitter said.

“They just sort of vanished,” Mitter said. “It’s like somebody went home one night and never came back.”

San Mateo police Lt. Mike Brunicardi said a resident contacted police Wednesday about the spa but didn’t file a report because it was a civil rather than a criminal matter. He added that a gift certificate is a contract between a business and a customer and doesn’t fall under the department’s jurisdiction.

The store had no “closed” sign in the window this week. A for-lease sign and locked door were the only indications the business had closed.

Russell Hitomi, a senior property manager for Coldwell Banker Commercial-Wilbur Properties in Palo Alto, said his company began eviction proceedings after the spa failed to pay its October rent of about $13,000. An unidentified woman then dropped off the keys Oct. 7 or 8, said Hitomi, adding that the business had occupied the building for at least 10 years and signed a five-year renewal lease just two months earlier.

“We’re going to go after them for the entire five years,” Hitomi said. “It may be kind of a moot point, because I’ve heard that (the owner) has filed for bankruptcy.”

Hitomi added that Coldwell Banker plans to bring in a liquidator to buy up the spa’s abandoned equipment and merchandise, which includes massage tables, robes, washers and dryers, facial creams and an assortment of Betty Boop dolls.

On its Web site, the spa bills itself as the “largest day spa in the Bay Area,” housed in an 8,000-square-foot facility. It also advertises a number of job openings, including for a receptionist and massage therapist.

The spa remained operational Friday and appeared to be accepting credit card payments for gift certificates. The spa’s phone was disconnected and owners Lionel and Sandra Caron did not answer a message left at their San Mateo residence or an e-mail seeking comment.

The spa received 1-1/2 stars on the popular Web site Yelp and just three positive reviews out of 29. Complaints mostly center on the decor and customer service, which one user described as “curt and snarly.”

David Finkelstein, an attorney representing the Carons in the dispute with Coldwell, said the two parties were in settlement discussions.

Finkelstein cited the “general downturn in the economy and retail businesses” as the primary reason for the spa’s closure.

It wasn’t clear whether some of the business’ financial difficulties sprang from civil lawsuits filed against it by women who accused an employee of fondling them during massages. A jury convicted 33-year-old masseur Kevin Bradshaw of inappropriately touching two women at Sandra Caron and another San Mateo spa, and he is currently serving a one-year sentence in San Mateo County jail.

In an Oct. 28 document filed in San Mateo County Superior Court, one plaintiff charges that the Sandra Caron spa rehired Bradshaw knowing he had been fired from Massage Envy in San Mateo after being accused of sexually battering a customer.

According to the court filing, Bradshaw regularly engaged in sexual activity with female clients at Sandra Caron and rubbed a customer’s breasts and pubic region without consent just one day before he was accused of making similar advances toward the plaintiff.

Todd Emanuel, the plaintiff’s attorney, said he was representing “multiple victims” in cases involving inappropriate touching at the spa. The spa’s attorney in the case, Peter Dixon, couldn’t be reached for comment.

Customers with Sandra Caron gift cards can apply 25 percent of their certificates’ value to any 60-minute regularly priced spa service at The Spa Studio on South B Street, owner Wendy Narlock said. In addition, former Sandra Caron customers will receive a 30 percent discount at their first appointment.

Narlock said she made the offer because she felt sorry for the customers and wanted to attract new business.

“I hope people don’t think that this is something that happens all the time,” Narlock said. “We’re definitely not a fly-by-night outfit.”
